Terms and Conditions
Reset Society
1. SCOPE
These Terms and Conditions apply to the activities of RESET WELLNESS STUDIO, LDA (hereinafter “RESET Society”), registered with the Lisbon Commercial Registry under corporate entity number 519124243, with its headquarters at Travessa Verbena, No. 1, 3rd floor, Lisbon, and a share capital of 1,000.00 euros.
The provisions herein are binding on all users of the website and visitors to the physical spaces managed by RESET Society, including its clients.
2. PLANS, SERVICES, AND PRODUCTS
The activities, services, and products available to RESET Society members are those offered at any given time on the website or at RESET Society’s physical locations.
RESET Society will make available, at all times, the catalog of sessions, services, and products, as well as the terms and conditions for scheduling or purchasing. This catalog, as well as the associated terms and conditions, may be changed at any time.
3. REGISTRATION AND PAYMENTS
Registration with RESET Society takes place in person at its facilities or through the website.
Upon registration, the customer may choose to purchase individual sessions or session packages, whether for activities or additional services. Session packages come with a set number of credits that the customer will use when booking sessions, as well as a maximum period within which these credits must be used. Once the specified period has elapsed, the credits will expire, and the customer will not be able to use them or receive a refund for them.
The prices for sessions and services, as well as the price and duration of session and service packages, are those set by RESET Society at any given time, as announced. The duration of session packages begins at the time of purchase.
The customer may opt for monthly renewable session packages. These packages can be purchased on any day of the month and become available immediately. The credits can be used for a period of one month and are renewed on the same day of the following month. The customer’s minimum commitment for these packages is 2 months, after which they may cancel the contract by providing 7 days’ advance notice to info@resetsociety.pt .
All payments must be made immediately and in full using the methods available at our physical locations or on our website. For monthly renewable packages, the customer may choose to pay by direct debit. Whenever this debit is declined, a new collection attempt will be made; however, upon the second return due to insufficient funds, a penalty of 5 euros will be applied.
Any change to the associated bank account or the designation of another method for monthly payments must be made at least 30 days in advance. If the customer cancels the direct debit authorization or requests its revocation without prior notice, RESET Society may charge an additional fee of 10 euros for each month in arrears and also reserves the right to collect the full remaining balance for the outstanding commitment period; the case will be referred to a collection agency, with legal fees of at least 60 euros charged to the customer.
For monthly renewable packages, any late or missed payments will result in the inability to schedule and attend sessions. After one month of outstanding debt, a collection process may be initiated, with the applicable penalties.
The minimum age for enrollment in RESET Society is 16 years old. For minors, enrollment must take place in person and be accompanied by those with parental responsibility, who will assume full responsibility for the minor’s physical safety, as well as for any situation that may arise, including any damage the minor may cause to the facilities.
4. PROMOTIONS AND POLICIES
When a customer benefits from a promotion or discount, it will not apply to the renewal of monthly renewable packages or to new purchases, unless expressly stated otherwise. Campaigns and/or promotions cannot be combined with other current offers. Customers who benefit from special terms must provide proof of their eligibility at each contract renewal to maintain the contracted terms.
5. SUSPENSION AND CANCELLATION OF THE CONTRACT
For monthly renewable packages, customers may request that RESET Society suspend the contract for a maximum of 2 months per year for packages with more than 225 credits, and 1 month per year for all other packages. To do so, the customer must contact RESET Society at least 7 days in advance of the suspension date. For these packages, it is also possible to extend, once per package, the validity of credits available at the time of renewal for an additional 30 (thirty) consecutive days.
The customer may, prior to the renewal date and subject to the minimum 2-month commitment period, cancel the monthly renewable session package contract in person or through the website.
6. CONDITIONS FOR ACCESS TO THE FACILITIES
Access to the reserved areas of the facilities managed by RESET Society is contingent upon customers scheduling sessions or services. Customers are not permitted to bring guests into the reserved areas without the express authorization of RESET Society.
RESET Society reserves the right to restrict access to the facilities it manages, particularly in the event of a customer’s failure to comply with the provisions of these Terms and Conditions.
7. SCHEDULING AND CANCELLATION OF SESSIONS
Sessions for the programs offered by RESET Society are available at the times and with the professionals announced each week.
The client may schedule a session through the website or in person, provided that the sessions are listed, spots are still available, and the client has purchased the credits required for the corresponding session, as advertised. Clients may also sign up for the waiting list for sessions that are fully booked, which allows them to receive a notification in the event of a cancellation. The notification sent does not constitute registration for the session in question; registration must be completed in person or on the website.
The customer may cancel the reservation for a scheduled session at any time. However, credits used will only be refunded if the cancellation occurs at least 12 hours before the start time of the reserved session. If RESET Society cancels a session for which the customer has registered, it will notify the customer as far in advance as possible and refund the credits used. Whenever a scheduled session is rescheduled and the customer is unable to attend at the new time, RESET Society will also refund the credits.
By registering for the sports activities offered by RESET Society, the client warrants that they have no medical contraindications for the physical activity they intend to practice and assumes full responsibility for any breach of this obligation. The client must not conceal from RESET Society any illness or condition that would prevent participation in the sessions offered. RESET Society reserves the right to reject registrations from clients who do not comply with the provisions set forth herein.
8. GENERAL SESSION TERMS
To access sessions for which the client has registered, the client must arrive at the facility’s reception desk 5 minutes before the scheduled start time of the reserved session. Failure to do so will result in the registration being considered canceled without regard to the minimum notice period, resulting in the total and non-refundable loss of the respective credits. The session begins at the exact time announced and scheduled; entry is not permitted after that time.
Clients must avoid any behavior that disrupts the sessions and must follow the instructions provided for their conduct. The session leader may ask any client to leave the session if their behavior is likely to jeopardize the normal operation of RESET Society or violates the provisions set forth herein.
If a customer damages any device, equipment, or instrument used at RESET Society, the customer is obligated to arrange for its repair, without prejudice to any termination of the contract by RESET Society. This amount is enforceable, and the customer shall be fully responsible for paying all court costs and attorney’s fees.
9. USE OF SHOWER FACILITIES AND LOCKER MANAGEMENT
It is the customer’s responsibility to safeguard their belongings; RESET Society assumes no liability for the safekeeping of belongings on its premises, including in cases of loss, theft, or robbery. It is prohibited to leave belongings in lockers after the designated usage period has ended and such items may be removed. If it is determined that the customer is misusing the locker, RESET Society reserves the right to open the locker and remove any items found inside.
If the customer is unable to open the locker due to loss of the code or key, they may go to the front desk to have it opened. If the locker is damaged, the customer will be charged for the repair costs.
Towels provided by RESET Society must be returned after each use; otherwise, the customer will be charged a minimum fee of 25 euros for each towel used.
Items turned in as lost will be held for a period of 7 days; after that time, if they are not claimed, RESET Society will dispose of them or donate them to others.
10. SCHEDULING SERVICES
In addition to the activity sessions, customers may also schedule complementary services provided at RESET Society’s physical locations. Depending on the service in question, these may be scheduled through RESET Society, in accordance with the terms and conditions in effect at the time, or directly with the respective professional. RESET Society assumes no responsibility for the terms of this scheduling, serving only to facilitate contact between the customer and the designated professional.
Credits purchased as part of session packages may not be used to purchase or schedule these services, unless otherwise stated.
11. GENERAL TERMS AND CONDITIONS OF SERVICES
The available services may vary according to the catalog available at RESET Society’s physical locations and on its website. When scheduling a service, the client must contact the professional directly and use, if necessary, the payment methods the professional has available.
RESET Society is not responsible for the quality or suitability of the services provided. The professional is entirely responsible for the services they provide, and the customer must clarify with the professional any questions they have, or that may arise, regarding the available and/or contracted services.
12. PURCHASE OF PHYSICAL PRODUCTS
The customer may also purchase physical products offered by RESET Society, either at its facilities or through the website. Physical products are those currently listed in the catalog, with the advertised qualities and at the price displayed at any given time.
Physical products may be purchased using the payment methods available in person or on the website; however, credits from purchased session packages may not be used for this purpose.
13. GENERAL TERMS AND CONDITIONS FOR PHYSICAL PRODUCTS
Physical products have the quality and condition displayed in our retail locations or described on the website. When purchased at our retail locations, products cannot be exchanged or returned. However, when purchased through the website, the customer has the right to cancel the purchase within 14 days of receiving the items. To do so, the customer must visit a RESET Society retail location. Products will only be accepted for return or exchange if they are unused and in perfect condition, and any applicable refund will be issued via the same payment method used for the purchase.
RESET Society is not responsible for the food products available; responsibility lies with the identified partner. RESET Society is only responsible for delivering these products to its physical locations, but not for their preparation or quality.
14. CONDUCT
All visitors to RESET Society’s facilities are required to respect one another; no insulting, abusive, or vulgar language is permitted, nor is any behavior that disrupts the well-being or activities of other visitors or the normal operation of the facility.
Access to the facility will be denied to customers who are under the influence of alcohol or any other substances. Smoking is prohibited in the studio, and pets are not allowed inside.
Eating food inside the exercise rooms is also prohibited, as is filming, taking photographs, or recording audio without prior authorization from RESET Society.
15. SAFETY AND HYGIENE
The use of a workout towel is mandatory during exercise sessions. Clients must arrive wearing appropriate clothing for the scheduled session and should follow the guidelines provided by RESET Society at the time of booking.
16. TERMINATION OF CONTRACT
RESET Society may suspend or terminate the contract entered into with any client who fails to comply with the provisions set forth herein, or who may endanger the health and well-being of other clients or employees at the facilities, cause damage to the facilities, materials, or equipment, or who may, in any way, affect the proper functioning of RESET Society, without prior notice or refund of amounts already charged.
17. STUDIO MAINTENANCE
RESET Society reserves the right to perform maintenance on all equipment and other electronic devices whenever it deems necessary and at any time, without prior notice. If necessary, construction work may be carried out in the studio, with a notice posted at the front desk or on the website regarding the scheduled start date and the estimated completion date; during this period, the validity of credit packages and monthly renewable packages will be suspended.
18. SAFETY AND RISKS
Participating in sports activities involves specific risks that vary from one sport to another. Customers must ensure they meet all the requirements for the sport in which they are enrolled, as well as comply with all stated and standard terms, posted safety signs, rules, and verbal instructions provided to them.
19. INSURANCE
For all intents and purposes, RESET Society ensures that service providers and their members enter into insurance contracts providing coverage for the activities they carry out, through the purchase of a workers’ compensation policy No. 209041261, a civil liability policy No. 209041269, and a personal accident policy No. 209042558.
20. INQUIRIES/COMPLAINTS
Any request for clarification or complaint must be submitted in writing at the reception desk or via email to info@resetsociety.pt . RESET Society also maintains an electronic complaints log. ASAE is the competent authority responsible for overseeing its activities.
21. EFFECTIVE DATE
Any changes made to these regulations take effect on the day following their posting at the studio and on the website, unless otherwise expressly stated. Whenever a change affects agreements in place, RESET Society will notify customers of the changes in question and offer them the option to terminate the contract, with a refund proportional to the portion of the contract period that has already elapsed or to the credits already used, whichever is lower.
22. FINAL PROVISIONS
The contract entered into, as well as these Terms and Conditions, are governed by applicable Portuguese law, and the Courts of the District of Lisbon shall have jurisdiction to resolve any disputes that cannot be settled amicably.
